Greenidge Generation, has filed a lawsuit against the New York Department of Environmental Conservation (DEC) after the agency denied its air emissions permit renewal. The permit, essential for the continued operation of the Bitcoin mining facility, is set to expire next month.
The DEC’s decision was based on the 2019 Climate Leadership and Community Protection Act (CLCPA), which aims to drastically reduce greenhouse gas emissions across the state.
According to the DEC, Greenidge’s operations conflict with the state’s climate goals. Greenidge, however, argues that the DEC overstepped its authority in making this decision and that the CLCPA does not grant the agency blanket permission to close businesses like theirs​.
In their legal challenge, Greenidge is seeking declaratory and injunctive relief, claiming that the DEC’s actions were based on an improper and incomplete analysis.
The company also argues that the DEC exceeded its jurisdiction, stepping into the regulatory domains of the New York State Public Service Commission and the New York Independent System Operator, which oversee electric-generating facilities in the state.
Environmental groups, including Earthjustice, have expressed strong opposition to Greenidge’s legal actions, viewing it as a last-ditch effort to continue their operations despite clear violations of the CLCPA.
