HIVE Takes Swedish Bitcoin Mining VAT Fight to EU

HIVE Digital Technologies has escalated a long-running Swedish value-added tax dispute to the European Commission, turning a disagreement over how Bitcoin mining compute is classified into a broader question about how European tax law treats industrial hashrate services.

The September 23 disclosure is important because the dispute reaches beyond one tax bill. At issue is whether HIVE’s Swedish subsidiaries were effectively mining crypto assets for themselves, as Sweden’s tax authority argues, or supplying taxable computing capacity to an identifiable customer under contract, as HIVE maintains.

The argument turns on what a miner actually sells

According to the legal filing described by HIVE’s counsel, Sweden’s Tax Agency changed its position in 2022 and treated the operations of Bikupa Datacenter AB and Bikupa Datacenter 2 AB as self-mining. That classification can prevent the businesses from recovering input VAT paid on equipment and other operating costs.

HIVE’s position is different. It says the subsidiaries supplied hashrate, or computing capacity, to an identified customer under contract and invoiced that customer periodically. In that model, HIVE argues the activity resembles a data-center computing service rather than an operator simply mining digital assets on its own account.

ASICs, electricity and cooling make VAT classification expensive

The distinction has unusually large consequences in Bitcoin mining because the business is capital and energy intensive. ASIC machines, electrical equipment, transformers, cooling systems and power purchases can all carry substantial taxes and operating costs. HIVE’s earlier disclosures discussed disputed Swedish input-VAT assessments totaling hundreds of millions of Swedish kronor.

The European Commission question is narrower than the tax case

The immediate complaint is not simply asking Brussels to overturn HIVE’s Swedish tax assessment. Recent reporting follows HIVE’s effort to challenge how the Swedish courts handled EU-law questions. Dentons says Swedish courts declined to refer the classification question to the Court of Justice of the European Union.

HIVE’s counsel is asking the European Commission to examine whether Sweden’s practice surrounding those referrals complies with Article 267(3) of the Treaty on the Functioning of the European Union. A separate request has sought consideration of the underlying VAT question through EU tax-policy channels.

Sweden remains part of HIVE’s global infrastructure footprint

The dispute comes while HIVE continues operating data-center infrastructure across Sweden, Canada and Paraguay.
